Overview
This Privacy and Cookies Policy defines how Parapli Transportation Solutions, LLC (“PTS,” “we,” “us,” or “our”) gather, analyze, use, disclose, and process information we gather about you and applies to the information collected about you via our websites, which include, without restriction, other websites operated by or on behalf of TPS, our software; our mobile applications, including, without limitation, Dashboard, (including mobile applications and web portals and any other versions of the foregoing); our internal employee website, the other internal communication services; via our third-party service providers that send email and text communications on our behalf; and our other products and services, which are accessible by computer, tablets, mobile phones, and other electronic devices, which may be branded by a trademark or reference or link to this Privacy and Cookies Policy (collectively “TPS Site(s)”) and your access to and use of the TPS Sites. This Privacy and Cookies Policy also pertains to (a) PTS’s collection, use, and disclosure of your personal information obtained by means other than through the TPS Sites and (b) certain communications via text and SMS messaging as more particularly outlined in the Section titled “Text and SMS Messaging” below.
You are highly encouraged to read this privacy and cookies policy thoroughly prior to each use of the PTS sites because we may periodically amend and post changes, and as this Privacy and Cookies Policy and our Terms of Use, and any future modification (www.paraplits.com/terms) govern your access to and use of the PTS Websites. They are available for your use as long as you agree to this Privacy and Cookies Policy and our Terms of Use. PTS has a legitimate interest in using the personal information you provide to us per this Privacy and Cookies Policy. If you do not consent to them, do not access or use the PTS sites. By accessing or using any of the sites or by providing your personal information or business information, you and the entity you are on behalf of (“you” or “your”) signify your agreement and consent to be bound by this privacy and cookies policy and our terms of use.
Be aware that a few third parties manage certain functions for PTS through their owned and operated websites. For example, we use a Transportation Management System (TMS) to streamline and optimize the physical movement of freight, stay compliant, and have proper documentation. A load board allows us to match shippers with carriers efficiently. Freight Factoring will enable us to vet shippers properly, invoice them, and pay our carriers on time. These third parties own and/or operate their websites, while PTS can access some functions and information collected via those websites for purposes such as recruitment, hiring, carrier and customer onboarding, and related information collection, etc...
Each website is subject to the applicable third parties’ privacy policy and terms of use. As such, we recommend that you read their policies before providing your personal information. To the extent PTS gathers, utilizes, processes, discloses, or does anything more with information gathered through those websites, our Privacy and Cookies Policy and our Terms of Use will apply; however, it will not apply to the overall functionality of the website and the third-party’s policies. Under these circumstances, these third-party websites are deemed “PTS Sites” due to the integration of functionality and utilization of information, and to those degrees, and those degrees only, our Privacy and Cookies Policy and our Terms of Use apply. For all other purposes, however, those specific third-party sites are subject to the applicable third party’s terms of use and privacy policy. You are encouraged to review and understand them before submitting any information via them.
Information Gathered
We gather information, including certain personal information, as defined under applicable law, which information amassed may include, without restriction, identifiers and contact information (for example, your actual name, pseudonym, email address, physical or mailing address, phone number, or unique personal identifiers like social security numbers or other government identification numbers/information (when required)). The data you supply to set up an account with us or to access certain of the PTS Sites (for example user ID, password, and for authentication purposes (such as account security questions)), mobile device unique identifiers, social media identifiers, location from which you are accessing the PTS Sites, user content including pictures or videos that you may upload to the PTS Websites or other content you post, communications that arise through our Sites or other written communications, customer support, performance data, product interaction, internet activity, information you may provide during employment or prospective employment at PTS, and recruitment (whether provided by you directly to PTS or through a third party, e.g., CareerBuilder, Indeed, LinkedIn, etc.), financial/payment information (such as in connection with making or receiving payments), commercial information (such as transaction history or other information pertaining to products/services), third party contact information that support business processes completed on your behalf, geo-location data (such as location data processed via the Carrier Dashboard app and/or information received via in vehicle devices), transportation and shipment information (such as origin and destination locations, shipment status and location) and other information pertaining to the provision of logistics services (such as information for customs clearance or security screening purposes), and other information when you participate in any of our promotions, contests, events, surveys, webinars, chats, requests for suggestions or similar activities. Remember that not all information defined above or below represents personal information.
Information automatically gathered may include, without restriction, device information such as unique device identifiers, hardware, IP address, through cookies, web beacons and related tracking technologies (see “Cookies” Section for more information), browser type, settings, language, usage details, and other information about your use of and interaction with our Sites. Moreover, we may use the information you provide to access, monitor, transmit, receive, delete, retrieve, store, maintain, and use the content in an account that you create with us, including your selections, keystrokes, and cursor movements to provide services to you, operate our Sites, or carry out our legal duties (for more information, please see PTS’s Terms of Use). This information may be merged with all formerly mentioned information.
Use of Gathered Information
PTS may utilize the information gathered in various ways, including, without restriction, to: (1) provide you with your requested products and services; (2) operate, analyze, and enhance our products, services and Websites; (3) render customer service to shippers, carriers, employment seekers, service and providers; (4) corresponds with you regarding your use of our products, services our Websites; (5) give transportation and shipment data and other information relating to the provision of services (such as information for customs clearance or security screening purposes) to our clients, carriers, and other third parties (including government entities) in association with the performance of logstics services; (6) give legal and administrative notifications; (7) reach you regarding a transaction or employment, whether through calls, emails, or text messages/SMS; (8) promote security and defend against identify theft and prevent fraud and other prohibited or illegal activity, claims and other liabilities; (9) conform to relevant laws and regulations; (10) take in payment for products and services (including as required by law obtaining government-issued identification information); (11) verify people and business identity with whom we correspond or conduct business; (12) enable the onboarding process including to determine qualifications and safety requirement for carriers; (13) pay carriers and other service providers; (14) promote other purposes disclosed to you through the PTS Websites or PTS’s marketing, presentations, or literature; (15) enable direct communication with carriers and other third-party service providers performing transportation or logistics services for PTS; (16) correspond with clients about promotions, contests, events, surveys, webinars, and to allow you to participate in and to administer these activities; (17) establish, exercise and/or defend legal claims including enforcing our Terms of Use or any other agreements; (18) observe and enforce compliance with related industry standards, company policies and legal and regulatory requirements; (19) observe and report compliance issues. We gather and utilize personal information solely for PTS's genuine interests in conducting its businesses and not for profit from transferring or selling personal information.
Disclosure of Information Gathered
We will not sell or disclose your personal information except as permissible by law, as described in this Privacy and Cookies Policy, or as disclosed to you. We also do not share personal information for cross-context behavioral advertising, as amended, as these terms are defined under the California Consumer Privacy Act of 2018. We may share the information gathered with: businesses that are owned by PTS or share common ownership with PTS; our third-party service providers (for services relating to technical support, IT support, data analytics, data management, information processing, customer service, payment processors, HR, recruiting, payroll, finance, accounting, sales, marketing, legal, business partner or customer intake or management, and financial institutions); businesses relating to the performance of logistics services; sanctioned law enforcement agencies, regulators, other public/government organizations, and other recipients of mandatary disclosures and legal claims (when mandatory by law, pursuant to courts order or any other legal procedure, governmental requests or any other legally enforceable demands, or to the extent otherwise required or permitted by applicable legal obligations).
PTS may also release information about you to third parties to stop or investigate a potential crime (e.g., identity theft or fraud), to establish, exercise, and/or defend legal claims while enforcing our Terms of Use or protecting our (or others) rights, property, or safety. Furthermore, PTS may disclose information gathered with other groups of third parties with your permission or as defined to you during the collection of your information. Part of our services necessitate you to divulge your information publicly because of the settings you have created (such as social media platform settings). We highly encourage you to read the privacy settings on these applications and adjust them to your preference. If you post content on our Websites via social networking or otherwise, that content may be seen by others who visit our Websites.
Retention of Gathered Information
PTS will maintain gathered information (e.g., personal and sensitive information, when applicable) while you have an account with us, as necessary to render you with services via our Websites or other services and/or products requested or fulfill the purpose(s) for which PTS has amassed it. Subsequently, PTS will maintain your information as long as reasonably necessary to: answer any queries from you; validate we properly behaved toward you; conform to any pertinent laws; maintain ordinary business continuity, in accordance with our standard data retention policies, which are based on legal and regulatory requirements as well as practical everyday business practices in the U.S.
SMS and Text Messaging
Our messaging program is offered on an “as-is” basis and may not be available in all areas at all times and may not work in the event of product, software, coverage, or other changes made by wireless service providers. We will not be liable for any delays or failures in the receipt of any mobile messages. PTS will send SMS TMs (terminating messages) if your mobile device is not compatible with MMS messaging. Message and data rates may apply. If you have any concerns or questions about your text or data plan, it is best to contact your wireless provider. Mobile message delivery is subject to effective transmission from your wireless service provider/network operator and is outside of our control.
PTS may correspond, including via the use of third-party providers, via SMS or text messaging, with (a) possible employees, (b) independent motor carriers, and (c) provide status reports to shippers and receivers. Our message program permits users to receive mobile messages based on mobile contact information provided directly to PTS; indirectly to our third-party partners, or to other third parties in connection with potential employment opportunities.
Our Privacy and Cookies Policy pertains to your participation in business transactions, employment and onboarding program, and informational and marketing communication to receive mobile messages from us, including from any third-party partner reaching out to you on our behalf, including, without restriction, messages via text/SMS and/or prerecorded or auto-dialed marketing mobile messages, thru the phone number you have given or at the phone number that someone might have given to us on your behalf after determining your potential interest in trucking with PTS, or in connection with your business or your potential business with us.
While you may consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our mobile messages are sent using an automatic telephone dialing system (“ATDS” or “autodialer”). Messages may come in the form of shortcode texts, which are 5- or 6-digit phone numbers used by businesses to send and receive text messages at scale.
If you do not wish to continue doing business with PTS or no longer agree to this Privacy and Cookies Policy, you agree to reply “STOP” to any mobile message in order to opt-out from us and any third-party providers that perform business functions for PTS. You may receive an additional mobile message confirming your decision to opt-out, and we will try to remove you from our contact list for the related phone number for this purpose within 10 business days. If you opt-in again by requesting our services or seeking, PTS will resume sending messages to the phone number connected with your opt-in. You comprehend and consent that the foregoing options are the only reasonable methods of opting out. You also comprehend and consent that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of our personnel or one of our third-party service providers to remove you from our list, is not a reasonable means of opting out.
You agree that you shall indemnify, defend, and hold us, our staff, and any third-party service provider we use to send text messages harmless from any claim or liability resulting from your failure to notify us of a change in the information you have provided, including, but not limited to, any claim or liability under the Telephone Consumer Protection Act, 47 U.S.C. § 227, et seq., or similar state and federal laws, and any regulations disseminated thereunder resulting from us attempting to contact you at the mobile telephone number connected to your account.
Reading or answering a text/SMS message while driving a motor vehicle can cause property damage, severe injury, or death to you or others. Do not read or respond to a message from us while driving or otherwise operating a motor vehicle. You shoulder all responsibilities for abiding by the foregoing and consent that you will at all times obey all related federal, state, and local laws, including, but not restricted to, receiving, reading, and/or sending text/SMS messages, phone calls, and/or any other communications with us. You consent to indemnify and hold us harmless to the fullest extent permitted by law for any and all claims of any nature arising out of or relating to any violations of this paragraph.
Your Options Concerning Information Collected
As pertinent law describes, your jurisdiction may give people certain rights relative to their personal information. Subject to related law and depending upon your jurisdiction, you may have the right to request access to and receive details about your collected personal information, update, and correct mistakes in your personal information, and/or delete the personal information, as applicable. These rights may be restricted in some situations by local law. You may exercise any such applicable right(s) to your personal information by:

Please include “Privacy Request” in the subject line and provide your name, state of residence (or country if outside of the U.S.), and the type of privacy request you would like to make. Please be mindful that certain rights may not apply to every instance of our collection, storage, or use of personal information and may not apply to you depending on your jurisdiction and applicable law. We reserve our right to deny any such request with or without direct confirmation from you, as permitted by applicable law.
● You may elect to disable the collection of information through cookies and other web protections, but this may affect your ability to use our Websites. If you have an account, you may be able to modify the profile information you have created with us by editing your account. Any information you post publicly may stay viewable by the public. If you no longer want to receive emails or other notifications from us, please follow the instructions in an email or other notification you receive to “unsubscribe” or “STOP” receiving them (as applicable).
The Security for Collected Information
We utilize diverse administrative, technological, and physical security methods to protect collected information. Nonetheless, these security measures cannot and do not guarantee the security or confidentiality of the information collected. Please be aware that, in the event, you create an account with us and choose a user ID and/or password; it is your responsibility to:
● control access to and the use of your user account, ensuring that no unauthorized individual has access to your account, user ID, or password;
● quickly inform us of any need to deactivate or modify your user ID, password, or security questions.
● comply with all of our instructions for utilizing, maintaining, or fixing your account.
While we utilize commercially intelligent security technology and implement robust policies and procedures to safeguard your privacy on our Websites, we shoulder no responsibility and are not answerable for any content submitted to your account or any content that is used or misused, whether submitted, used, or misused by you, your designees, and/or other third parties. All your acts and omissions and those of unauthorized users who access our platforms via your user ID and password shall be considered your acts and omissions.

COOKIES
PTS utilizes and permits certain third parties to use cookies, web beacons, and other related tracking technologies (together, "cookies") on our Websites. Cookies are small files of text or numbers that websites send to your browser when you visit them. Some are deleted once you close your browser, while other cookies are kept even after you close your browser so that you can be recognizable when you revisit the same website. PTS utilizes cookies and permits certain third parties to place cookies on its Websites to provide its Websites and services, collects information about your habit patterns when you navigate its Websites to improve your custom-made experience, and comprehends usage patterns to enhance its Websites, products, and services. PTS may also permit certain third parties to place cookies on its Websites to gather information about your online usage its Websites over time and across different websites you visit. Third-Party Service Provider Cookies
The following offers more information regarding cookies that may be used by certain of the Career Site third-party partners and service providers:
● Dropbox: When a user chooses to upload any documents through a Dropbox account, it will use a third-party cookie on a career site. Dropbox policies are managed by an exclusively separate privacy policy, and questions associated with Dropbox’s policies should be addressed to it. By utilizing Dropbox to upload information to a career site, you are agreeing to the third-party cookie.
● Google Drive: When a user chooses to provide any documents via a Google Drive account, Google Drive will use a third-party cookie on the career site. Google Play Store and Apple App Store
You agree that the acknowledgments and understandings set forth in this Privacy and Cookies Policy are solely between you and PTS, not Google or Apple and that Google is not liable for the Google Play Store’s Apps or their content, just as or Apple is not liable for Apple’s App Store’s (“App Store”) Apps their content. Neither Google nor Apple have any responsibility to provide any maintenance or support services in connection with Google Play Store or App Store Apps.
You will not include Apple or Google in any claims relating to your use of App Store Apps, Google Play Store Apps, or in any third-party claims alleging infringement of intellectual property rights by the App Store Apps or Google Play Store Apps. You consent to comply with all third-party agreements in connection with your use of App Store Apps and/or Google Play Store Apps (for example, your wireless provider agreement).
Lastly, you consent that Apple and Apple’s subsidiaries are third-party beneficiaries of this Privacy and Cookies Policy solely for the purpose of enforcing pertinent terms against you in association with your usage of the App Store Apps. Correspondingly, you consent that Google and Google’s subsidiaries are third-party beneficiaries of this Privacy and Cookies Policy exclusively for the purpose of enforcing related terms against you in association with your use of Google Play Store Apps.
